Florida Bar Association praises DeSantis for putting Florida families first

On behalf of the Florida Bar Association's Family Law Section, we would like to thank the Florida State Legislature and Governor Ron DeSantis for their significant actions in passing and signing several important pieces of legislation that greatly improve and protect the lives of families in our state.

The legislative actions – House Bill 521, Equal Distribution of Marital Assets and Liabilities; House Bill 385, Safe Exchange of Minor Children; Senate Bill 86, Hope Cards for Individuals with Protection Orders; and House Bill 761, Petitions for Restraining Orders in Interpersonal Violence – represent significant steps forward toward ensuring justice, safety and support for all Florida families.

A cornerstone of a fair and just family law system is the equitable distribution of marital assets. The recent legislation improves fairness and clarity in this area, and we want to thank the sponsors – Representative Traci Koster and Senator Erin Grall – for expertly shepherding the legislation through the process. This update is critical to provide appropriate guidance to the judiciary and give both spouses the opportunity to rebuild their lives on a stable financial footing, promoting a more balanced and equitable process for all involved.

Significantly, the legislature also passed a Safe Exchange of Minor Children Act, sponsored by Representative Joel Rudman and Senator Clay Yarborough. This bill was created under horrific circumstances and is designed to ensure the well-being of children and families during child exchanges, but it does so by strengthening the law that gives courts the ability to determine if an imminent danger makes it necessary to exchange a child at a neutral, safe exchange location designated by the local sheriff or a supervised visitation center.

By passing this law, which allows for the safe exchange of minor children and protects both the child and the guardian, lawmakers have taken a proactive step to minimize the potential for conflict and trauma during such transfers.

In addition, the Hope Card program approved by the Legislature and signed into law by the Governor represents a significant step forward in supporting victims of domestic violence. Providing critical information and resources in a discreet and accessible format, these cards give victims the tools they need to seek help and stay safe. By making support more accessible, the Legislature and Governor have demonstrated a deep commitment to protecting and supporting the vulnerable. We are also grateful to Representatives Michael Gottlieb and Traci Koster and Senator Lauren Book for their unwavering support of this measure.

Likewise, addressing interpersonal violence is a critical issue that affects countless individuals and families. The passage and signing of HB 761, Interpersonal Violence Injunction Petitions Interpersonal Violence, underscores our state's commitment to addressing and curbing this widespread problem. By strengthening legal protections and resources for victims of interpersonal violence, Florida is setting a commendable standard in its efforts to create safer communities and hold perpetrators accountable.

The Florida Bar Association's Family Law Section is grateful to the sponsors of each of these bills for the opportunity to provide input and sincerely thanks the legislature for their legislative action and Governor DeSantis for his determination to sign and enact these bills.

These policies are not mere legal formalities; they are lifelines that put Florida's families first and promote justice, safety, and support for all Floridians. Together, we are taking meaningful steps to ensure our family law system continually evolves to meet the needs of those it serves.
